Robert Helton Hays, Sr. (May 30, 1897 - June 15, 1979) was born in Barbourville, Kentucky to Joseph Smith Hays and Ella Helton. Hays graduated from Yale University in 1918. He served as a public school teacher before receiving his LL.B. from the University of Kentucky in 1921. Hays worked as general counsel for the Burley Tobacco Growers Co-op Association from 1924-1929 and for a bank from 1929-1935. In 1935, he entered private practice in Lexington. Hays married Mary Elizabeth Davis in 1924.

Three of Hay's brothers (William Oscar Hays '35, Joseph Smith Hays '16, and Elmer Dishman Hays '14) were also graduates of the University of Kentucky College of Law.
