Description

The only certainty in CCR management is regulatory uncertainty! As we approach 2026, the industry and “CCR Universe” faces significant challenges and uncertainties due to the proposed EPA rule expected early in the year. This panel discussion will bring together a diverse group of industry experts, including representatives from associations (e.g. EEI), legal professionals, utility representatives, and consultants, to address the hard questions head-on and provide insight to and understanding of the implications of these regulatory changes. Key discussion points will include: • Legal Ramifications and Possible Pathways for 2026: Exploring the potential major pathways considering the proposed regulations and the establishment of state permit programs. • Current Efforts and Approach to Regulatory Compliance: Considering the ongoing efforts and strategies to follow the CCR rules based on historic trends and future positions. • Impacts to the Industry: Discussing the effects of coal-fired generation retirement delays, the increase in data centers, battery storage, and other grid stabilization needs. • Best Practices to Prepare for Regulatory Changes: Sharing options analysis, strategy, and planning to navigate the regulatory landscape in 2026 and beyond. • Significant Topics and Concerns: Addressing critical issues such as beneficial use, the impact of liquid and CCR, and groundwater risk-based solutions. This panel aims to provide a platform for a healthy discussion on the legal, technical, compliance, and other factors influencing CCR management. By approaching these topics from various viewpoints, we aim to achieve a comprehensive, crowdsourced understanding of the challenges and opportunities ahead. Note to WOCA: I will review and revise the abstract (1) after panelists are selected and confirmed and (2) the proposed regulations are issued (as best I can) to comply with all dated from the organization.
